STANDARD TERMS AND CONDITIONS FOR CLIENTS AND USERS

INTRODUCTION

Rentiva (Pty) Ltd (“Rentiva“) operates a website under the domain www.rentiva.co.za (“the Website“) for the online marketing of property listings for sale or rent, as well as advertising services related to real estate, legal, and associated industries (collectively referred to as “Advertisements”).

Rentiva reserves the right to amend these Standard Terms and Conditions (“STCs“) at any time without prior notice.

By accessing or using the Website, you agree to comply with and be bound by these STCs. If you do not agree, you must refrain from using the Website.

APPLICATION TO CLIENTS

These STCs apply in conjunction with the signed agreement (“the Contract“) between Rentiva and any client advertising on the Website (“Client“).

In case of any conflict between these STCs and the Contract, the terms of the Contract shall prevail.

APPLICATION TO USERS

By registering, logging in, or otherwise accessing the Website, all users (“Users“) agree to be bound by these STCs, except where certain provisions explicitly apply only to Clients.

RENTIVA’S GENERAL OBLIGATIONS AND WARRANTIES

Rentiva shall provide the following services to Clients and Users:

  • Display and market Advertisements on the Website, subject to limitations on quantity, type, and content as determined by Rentiva.
  • Offer telephonic support Monday to Friday, 08:00 to 17:00.

Rentiva makes no warranties regarding:

  • The Website being error-free or continuously accessible.
  • The safety of downloads or third-party applications linked to the Website.

The Website is provided “as is,” and Rentiva disclaims all liability for any inaccuracies or damages arising from its use.

CLIENT OBLIGATIONS AND WARRANTIES

Clients must:

  • Ensure all Advertisements comply with Rentiva’s specified requirements.
  • Avoid posting false, misleading, offensive, or infringing content.
  • Adhere to all applicable laws and regulations.

Clients indemnify Rentiva against any claims arising from breaches of these STCs or intellectual property violations.

Rentiva upholds equality and prohibits discrimination based on gender, race, creed, or socio-economic status in all Advertisements.

USE OF THE WEBSITE

  • Users acknowledge that Rentiva does not verify Advertisement accuracy.
  • Cookies are used to enhance user experience; disabling them may limit functionality.
  • Unauthorized linking to the Website requires prior written consent.
  • Third-party website links are accessed at the user’s own risk.

RESTRICTIONS

Clients and Users are prohibited from:

  • Republishing Website content elsewhere.
  • Using the Website for harmful, illegal, or commercial data-mining activities.
  • Engaging in unauthorized advertising or marketing.

DIRECT MARKETING, COOLING-OFF PERIOD, AND REFUNDS

  • Clients may cancel Direct Marketing Contracts (initiated by Rentiva) within 5 business days for a full refund.
  • No other refunds are permitted unless explicitly stated.

PRIVACY POLICY AND PERSONAL INFORMATION

  • Users and Clients consent to Rentiva collecting personal data (“Personal Info“) for service provision, marketing, and legal compliance.
  • Users have rights under the Protection of Personal Information Act (POPIA), including access, correction, and objection to data processing.

INDEMNITIES AND WAIVERS

  • Rentiva is not an estate agent, attorney, or financial advisor.
  • Users and Clients waive claims against Rentiva for losses related to Website use or Advertisement reliance.

CONFIDENTIALITY

  • All business-related information must remain confidential unless publicly available or disclosed with consent.

INTELLECTUAL PROPERTY

  • All Website content, trademarks, and software are owned by Rentiva.
  • Unauthorized copying, reverse-engineering, or misuse is prohibited.

PHOTO AND VIDEO CONTENT

  • Rentiva retains ownership of all Visual Content (photos, videos, etc.) created for Clients.
  • Clients may use approved content only on authorized platforms.

VARIATION OF TERMS

Rentiva may update these STCs at any time; Users are responsible for reviewing them periodically.

DISPUTE RESOLUTION

  • Disputes first escalate to management, then to arbitration in Johannesburg under AFSA rules.
  • Courts may grant interim relief if necessary.

GOVERNING LAW

These STCs are governed by South African law, excluding conflict-of-law principles.
